In Maryland, when a doctor or other health care provider agrees to diagnose or treat a patient, he or she has assumed a duty of care toward that patient. The definition of “Medical Malpractice,” also known as “Medical Negligence,” is negligence committed by a health care provider whose performance of duties deviates from the standard of care of those with similar training and experience, which results in medical injury to a patient.
“Medical injury” means injury or death resulting from rendering health care or failing to render health care. Therefore, Medical Negligence in Maryland occurs when there is:
1. a negligent act by a Doctor or other health care provider which results in injury to the patient;
2. an omission or failure to act by a doctor or other health care provider resulting in injury to the patient.
Medical Negligence is not limited to the actions of Doctors, such as Neurologists, Oncologists, Cardiologists, Internists, Obstetricians, Gynecologists, and Surgeons. Maryland law covers the actions of “health care providers,” which also includes nurses, dentists, dental staff, hospitals, nursing homes and nursing home staff, medical day care centers, hospice care programs, assisted living programs, optometrists, osteopaths, ambulatory care facilities, chiropractors, podiatrists, psychologists, licensed certified social workers, clinical social workers, and physical therapists.
Medical Negligence cases include claims against the health care providers and health care institutions for medical negligence which occurred due to:
- The Failure to Diagnose;
- Misdiagnosis;
- Child Birth Injuries (such as Cerebral Palsy, Brachial Palsy, and Facial Paralysis);
