Your Rights

1) You have the right to have the vehicle repaired at any body shop of your choice. The insurance company may not dictate which shop you use;

2) You have the right to get new parts, not salvaged parts, on your vehicle;

3) You have the right to get vehicle parts which are approved by the manufacturer of your vehicle;

4) You have the right to receive alternative transportation due to your loss of use of the vehicle while it is being evaluated. The insurance company can provide a rental car or pay you an amount to cover the cost of a rental;

5) You have the right to receive prompt payment of property damage claims from the insurance company when there is no significant dispute as to liability or as to amount of property damage even though a personal injury claim is still pending;

6) You have the right to reject the insurance company’s settlement offer and make a counteroffer based on:

(a) Dealer quotations for a substantially similar motor vehicle;

(b) Advertisements for a substantially similar motor vehicle; or

(c) Any other source of valuation for a substantially similar motor vehicle.
